Unless there is evidence that one or more people have made an extensive and significant effort to obtain a free image and determined that no such image exists and there is no non-free image that could reasonably be released under a free license if asked, then an image of a recently deceased person cannot meet the non-free content criteria. I see no evidence that anyone has made any effort, let alone an extensive and significant one.
