The result was to delete the image.

It is disputed whether or not this image violates our non-free content criteria.

  • The reason given is: This is an historical photo of Dix Stadium, taken in 1970, shortly after the stadium's construction and opening in 1969. As such, there have been several changes to the stadium since then, so a replacement of this actual photo is not totally possible. In addition, it is a rare aerial image of the stadium, so getting a "free" replacement would be difficult. The following comes from the Kent State website:

"The photo library contains images that were taken from assignments and day-to-day feature opportunities. Photographs included in this archive are intended for the marketing and public relations needs of Kent State University. These images are not to be sold, placed in a publication that will be sold, or used to promote any product or place other than Kent State University. Except for portraits, these images are naturally occurring photos that accurately depict the dynamic living and learning environment at Kent State University. They cannot be altered or manipulated without permission." (emphasis added, from http://imagine.kent.edu/photoarchive/ accessed 9 August 2007)

This photo of Dix Stadium fits the criteria the University has set for release of its photos in that the article is free, it promotes Kent State University, and the photo has not been altered or manipulated in any way.

Closing admin comment - the image isn't being used to illustrate a discussion about the stadium after it was opened but of the stadium generally. It is entirely feasible that a free image of the stadium now can be obtained therefore the image is replaceable and not therefore usable under our fair use policy. Concerning the license, please bear in mind that wikipedia is GFDL licensed and that this use is not always going to be compliant with the university license in future uses.
